New York Blood Center, Inc. (collectively, “NYBC,” “NYBCe.,” “us,” “we,” or “our”) is a New York not-for-profit corporation that serves local communities throughout the United States, including Connecticut, Delaware, Kansas, Maryland, Minnesota, Missouri, Nebraska, New York, New Jersey, Pennsylvania, Rhode Island, Virginia, western Wisconsin and southern New England. We aim to protect your privacy in connection with your use of our websites, including www.nybc.org, www.nybce.org, www.delmarvablood.org, www.savealifenow.org, www.mbc.org, www.ncbb.org, www.ribc.org, www.ctblood.org, www.projectachieve.org, www.nybcventures.com and www.comprehensivecellsolutions.org (the “Sites”), mobile applications, including the Donor Plus mobile app (the “App”), and any other technologies, features, and content we offer (collectively, our “Services”).

This privacy policy (the “Privacy Policy”) governs how NYBC collects, stores, uses, and discloses your Personal Data (as defined below), as well as other data and information arising out of or relating to you and your use of our Services. Please read the following carefully to understand our practices regarding your Personal Data.

By using the Services, you acknowledge and agree that your use of the Services is governed by our Terms of Use. To keep things simple, we use the same capitalized terms as those set forth in our Terms of Use. 

Our data practices with respect to the Services may change. As a result, we may make changes to this Privacy Policy at any time to reflect our current data practices. If we modify the Privacy Policy in the future, we will publish such modifications on this page. Please review this Privacy Policy from time to time, and especially before you provide any Personal  Data.

Personal Data We May Collect.

As used in the Privacy Policy, “Personal Data” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with an identifiable individual. Personal Data includes “personal information,” as that term is defined in applicable privacy laws. Personal Data does not include publicly available information; lawfully obtained, truthful information that is a matter of public concern; or information that has been de-identified or aggregated consumer information. 

Information you provide us

Depending on how you use the Services, you may provide us with the following types of Personal Data: 

  • Contact information and identifiers. When you set up a donor account with us, we may ask you to provide certain contact information and identifiers, including your first and last name, email address, physical or mailing address, phone number, date of birth, and username and password, driver’s license number, passport number, or other similar identifiers. We may also collect your social media credentials if you choose to access the Sites via a social media platform.
  • Application information. When you apply to volunteer with us or create a donor profile, we may ask you to provide certain contact information, including your first and last name, physical address, email address, phone number, emergency contact information, date of birth, gender, ethnicity, education information, and employment information.
  • Donor Profile and health information. Through your donor account, we may display certain health information after you make a blood donation or you may provide us with certain health information such as blood type, general health information and diagnoses, medications and vaccinations, pregnancy status, sexual health history, travel history, drug use, and height and weight.
  • Financial and payment information. When you support us through a financial donation, we may utilize a vendor that collects certain payment information such as your credit card number, your donation amount, and the date of the donation. We may process such payment information as a tokenized credit card or debit card number.

In addition to the information described above, we may collect additional information from you from different sources. For example, in addition to collecting contact information when you create a donor account, we may also collect contact information when you complete a form on the Sites.

Information we automatically collect

When you interact with our Services, we or one of our vendors may automatically collect certain information about you through tracking technologies such as cookies, pixels, web beacons, embedded scripts, and tags (“Cookies”). Cookies allow a website to recognize a visitor’s device, record a visitor’s preferences, and track pages that are popular on a website.  The information we may automatically collect includes:

  • Browser and device data, such as IP address, device identifier, device type, operating system and Internet browser type, screen resolution, operating system name and version, device manufacturer and model, language, plug-ins, add-ons, and the language version of the Sites you are visiting; and
  • Usage data, such as geolocation data, browsing history, time spent on the Sites, pages visited, links clicked, language preferences, patterns of use, and the pages that led or referred you to our Sites.

We may use cookies for various purposes, including to collect information about the individual web pages or products that you view, what websites or search terms referred you to our Sites, and information about how you interact with the Sites, improve features and content on our Sites, and for advertising purposes. For example, we may use the cookies listed below for the following purposes:

  • We may use Google Analytics for purposes such as evaluating your use of the Services, compiling statistic reports on the Services activity, and providing other services relating to Services activity and other Internet usage.   • We may also implement Google advertising features such as dynamic remarketing, interest-based advertising, audience targeting, behavioral reporting, demographics and interests reporting, user segment analysis, device reporting, display advertising, and impression reporting.   • When we use Microsoft Advertising on our Sites, Microsoft may collect or receive certain information, as described in its Privacy Statement.
  • We may use the Meta Pixel to collect or receive information on our Services and use that information to target and deliver ads. 

Most browsers are initially set up to accept cookies. If you do not want information collected through the use of cookies, you can reject cookies using a procedure available in most browsers. NYBC provides no assurances or guarantees about the use of cookies on other websites that you may visit as a result of information or links found on the NYBC website. Please note that blocking certain cookies when using the Sites may prevent you from using some of the features on our Sites. Additionally, by disabling cookies, you may invalidate opt outs that use cookies to recognize devices that have opted out.

We also collect information about your online activities on websites and connected devices over time and across third-party websites, devices, apps, and other online features and services. Your web browser may have settings that allow you to transmit a “Do Not Track” signal when you visit various websites or use online services. Our Sites are not designed to respond to “Do Not Track” signals received from browsers.

Certain analytics and advertising companies may participate in the Digital Advertising Alliance (“DAA”) AdChoices Program and may display an Advertising Option Icon for Interest-based Ads that links to an opt-out tool which allows you to exercise certain choices regarding targeting. In addition, certain advertising networks and exchanges may participate in the Network Advertising Initiative (“NAI”). NAI has developed a tool that allows consumers to opt out of certain Interest-based Ads delivered by NAI members’ ad networks. Please be aware that, even if you are able to opt out of certain kinds of Interest-based Ads, you will continue to receive non-targeted ads. Opting out of one or more NAI or DAA members only means that those selected members should no longer under the DAA / NAI rules deliver certain targeted ads to you. This will affect this and other services, but does not mean you will no longer receive any targeted content and/or ads (e.g., from other ad networks). If your browsers are configured to reject cookies when you visit this opt-out page, or you subsequently erase your cookies, use a different device or web browser(s), or use a non-browser-based method of access (e.g., mobile app), your NAI / DAA browser-based opt-out may not, or may no longer, be effective. Mobile device opt-outs will not affect browser-based Interest-based Ads even on the same device, and you must opt-out separately for each device. We are not responsible for the effectiveness of, or compliance with, any third-parties’ opt-out options or programs or the accuracy of their statements regarding their programs.

Information collected through your device

When you download or access our App, we may (depending on your device or permission settings) have access to certain information from your device, such as:

  • Location Information. We may use location-aware technologies to precisely locate you (as determined by your IP address, GPS, Bluetooth, or Wi-Fi signals, including information about nearby Wi-Fi networks, location beacons, and cell towers) for purposes such as locating the closest blood donation center to you. 
  • Identifiers.When you use the App, we may get certain contact information such as your name, email address, or phone number.
  • Camera. You may be able to upload certain content such as photos and videos through the Apps. 
  • Device Information and Device ID. We may get information about the device you use, including the model of your device and its operating system, your IP address, device ID or other unique identifier.
  • Usage Data.When you use the App, we may get certain information such as the time and length of your App use, and other usage data. 

Aggregate, Deidentified, or Anonymous Information

Under certain circumstances, NYBC may create aggregated, de-identified, or anonymous information from Personal Data. Subject to applicable law, our use of such aggregated, de-identified, or anonymized information is not Personal Data or subject to this Privacy Policy. We maintain and use de-identified data only in a de-identified fashion and not to attempt to re-identify the data. 

Use of Personal Data.

We may use the Personal Data we collect about you for various purposes, including: 

  • To provide you with our Services, products, or other materials you request (for example, to set up your donor account or to process your financial donations)
  • To communicate with you including about our Services, donation programs, policies, and our Donor Advantage Rewards Program
  • To determine your donor eligibility status 
  • To process your volunteer application 
  • To customize your experience with our Services, including by providing you with relevant advertising 
  • To operate and improve our Services
  • To conduct internal analyses, such as surveys, studies, market research, monitoring or analyzing trends, usage and activities
  • For internal administrative purposes
  • To protect the security and integrity of our Services
  • To enforce our legal rights
  • To comply with our policies, industry standards and applicable laws, regulations or legal processes
  • Otherwise with your consent

Disclosure of Personal Data.

We may disclose Personal Data that we process, to the following:

  • Our affiliates. We may disclose Personal Data among our affiliates to provide our Services, and for internal administrative purposes.
  • Our vendors. We disclose Personal Data with our  vendors to provide services on our behalf, such as payment processing, analytics, advertising, hosting, marketing, customer and technical support, and other services. These vendors may have access to your Personal  Data only to perform these tasks on our behalf and are obligated not to disclose or use the information for any other purpose.
  • Platform advertising vendors and partners. We may disclose your Personal Data with advertising vendors and partners who assist us in serving advertising to others who may be interested in our Services. We also partner with vendors who use Cookies to serve interest-based advertising and content on their respective platforms that may be based on your preferences, location, and/or interests.
  • Compliance with laws or to protect our Services. Under certain circumstances, we may be required to disclose your Personal  Data if required to do so by law or in response to valid requests by public authorities.
  • Affiliate and business transfers and transactions. If we or our subsidiaries are involved in a merger, acquisition, asset sale, or other corporate combination, your Personal Data may be transferred to the acquiring or surviving entity.

We may also disclose Personal Data with your consent or at your direction.

We may disclose non-Personal Data, such as aggregated user statistics, to third parties. Our use of aggregated, anonymized, and de-identified data is not subject to this Privacy Policy.

Use by Children.

The Servies are intended for persons 13 years of age and older. NYBC does not knowingly collect, use or disclose Personal Data from a minor under the age of 13. If you become aware that a child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from children without verification of parental consent, we take steps to remove that information from our servers. 

Data Security.

NYBC uses a variety of security measures and takes reasonable steps to protect your Personal Data. Although NYBC has procedures in place to safeguard the information that we collect online, no Internet transmission is ever fully secure or error free. 

Data Retention.

We will retain your Personal  Data for as long as is necessary to provide you with our Services, to maintain our donation records, to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies. We will also retain certain Personal Data for internal analysis purposes. 

Links to Other Websites.

This website may contain references or links to other websites not operated or controlled by NYBC. These third-party websites are not covered by this Privacy Policy or the policies and procedures which NYBC applies. Therefore, if you follow a link posted here to third-party websites, we provide no assurances or guarantees about these other websites, including their ability to safeguard your Personal Data, and NYBC accepts no liability for links from this website to others. NYBC cannot endorse or guarantee any information you may find on links followed from NYBC’s Services. We suggest that you contact those websites directly for information on their privacy, security, data collection and distribution policies, as well as their content. NYBC is also not responsible for any third-party websites that may contain links to this website.

The Services may permit you to interact with other websites or online services, such as enabling you to “like” NYBC on another site or “share” content from the Services with other sites (a “Social Feature”). If you choose to “like” or “share” content or post information using a Social Feature, that information may be publicly displayed, and the other party may have access to certain information about you and your use of the Services. Similarly, if you interact with us through Social Features, we may have access to information about you (for example, if you “like” or “follow” our page on another website). Please note that if you mention or comment about NYBC or our Services in your post to another platform, that platform may allow us to publish your post on our Site.

Your Privacy Rights and Choices.

Opting out of promotional electronic communications from us

There may be certain circumstances where NYBC will use Personal Data obtained through the Services to contact you (for example, responses to your email inquiries or recruiting for blood donations). If at any time you wish not to receive communications from us, you may indicate so by using the procedures described under Contact Us below or by following the instructions in the e-mail you received. Please note that if you opt out of receiving promotional emails from us, we may still send you important administrative messages that are required to provide you with the Services or for other reasons disclosed in this Policy.

Device settings and permissions

You can use your mobile device settings to limit our collection of certain information. Please note that some App features may not function properly if certain permissions are disabled or settings are changed.

With respect to Apps, you can stop all collection of data by the App by uninstalling the App. Also, you may be able to exercise specific privacy choices, such as enabling or disabling certain features (e.g., location-based services, push notifications, accessing calendar/contacts/photos), by adjusting the permissions in your mobile device and/or the App’s settings. If GPS precise location services are disabled, other means of establishing or estimating location (e.g., connecting to or proximity to Wi-Fi) may persist. 

Note that uninstalling the App or changing the App permissions will not delete your user account or any information we previously collected via the App.

Subject to our compliance with applicable law, if you wish to delete your account including associated account data with your App account, please email us at [email protected] and request your App account deletion. 

For California Residents

We do not disclose Personal Data to third parties for their own direct marketing purposes. However, California residents have the right to request information regarding such practices under California’s “Shine the Light” law. We do not “sell” Personal Data as that term is defined under Nevada law.

Additional privacy rights for Connecticut, Delaware, Minnesota, Maryland and New Jersey

If you reside in Connecticut, Delaware, Minnesota, Maryland, and New Jersey, you may have certain rights and choices regarding our collection, use, and disclosure of your Personal Data.

Although we do not sell Personal Data in exchange for money, some of the ways that we disclose Personal Data for advertising may constitute a “sale” or “targeted advertising” under certain state privacy laws. We have sold or processed the follow categories of Personal Data to third parties, including marketing and advertiser platforms, for the purposes of providing NYBC analytics and targeted advertising:

We do not charge a fee to process or respond to your authenticated consumer request unless it’s excessive, repetitive, manifestly unfounded, or in accordance with applicable law. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Please note that, if you submit privacy rights requests, we may ask you for specific information to help us authenticate your identity prior to processing your request. We cannot respond to your request or provide you with Personal Data if we cannot authenticate your identity or authority to make the request and confirm that the personal data relates to you. Generally, a rights request must include:

  • Sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Data or an authorized representative, which must include, at a minimum, your first and last name and email address.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to the request.

Depending on applicable law, you may be limited in how many authenticated consumer requests you make within a twelve (12) month period.  If we have collected information on your minor child, you may exercise the above rights on behalf of your minor child.  Additionally, in some jurisdictions, you may designate an authorized agent to submit a request on your behalf, and if so, we may require proof of the agent’s authorization by you and/or verification of the agent’s own identity.

Right to Confirm, Access, Know. You have the right to request confirmation of whether we process Personal Data relating to you, and if so, to request a copy of that Personal Data.

Right to Delete. You have the right to request that we erase your Personal Data in certain circumstances provided by law. Please note that an exception to your deletion request may apply. For example, we may deny a deletion request if retaining the information is necessary for us to:

  • Comply with federal, state, or local laws, rules, or regulations
  • Complete the transaction for which we collected the Personal Data, provide a product or service your requested, or perform a contract to which you are a party 
  • Take immediate steps to protect an interest that is essential for the life or physical safety of you or another natural person;
  • Engage in public or peer-reviewed scientific or statistical research in the public interest

Right to Correct. You have the right to request to have your Personal Data  corrected or updated if that information is inaccurate, outdated, or incomplete.

Right to Opt Out. You have the right to opt out of the processing of your Personal Data for the purposes of (a) targeted advertising; (b) “sales” as defined under applicable state privacy laws; or (c) profiling in furtherance of decisions that produce legal or similarly significant effects. To exercise your opt-out rights, you can click Cookie Settings in the footer of the Sites. You may also designate an authorized agent to exercise your opt-out rights, but you may still need to authenticate your identity directly with us before your request can be processed.

Right to Know Third Party Disclosures. If you reside in Delaware, Maryland, or Minnesota, you also have the right to obtain a list of specific, or categories of, third parties to which we disclose Personal Data. This list may be limited to entities or categories of entities that specifically receive your Personal Data depending on applicable law.

International Visitors.

NYBC is based in the United States. If you are using our online Services outside the United States, please be aware that Personal Data we obtain about you may be transferred to and processed in the United States or other jurisdictions outside your own. Your Personal Data may be accessible by public authorities where it is processed. By using our Services and providing your Personal Data, you acknowledge that your Personal Data may be transferred to and processed in jurisdictions other than your own. Please be aware that the data protection laws and regulations that may apply to your Personal Data transferred to the United States or other countries may be different from the laws in your country of residence. 

Please note that if you participate in our Comprehensive Cell Solutions program, a notice regarding our data practices will be provided to you before we collect any information from you.

Updates To This Privacy Policy.

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the “Last updated” date at the top of this Privacy Policy. You are advised to review this Privacy Policy periodically for any changes. If we make any material changes to the Privacy Policy, we will let you know via email and/or a prominent notice on our Services, prior to the changes becoming effective.
